Terms and Conditions

These terms and conditions apply to all orders for delivery outside of the UK. Placing an order constitutes your acceptance thereof. Despatch of the products by us constitutes acceptance of the order by us and the commencement of our contract to supply. Your contract for supply is with Thompson & Morgan (a division of Branded Garden Products Ltd). Your statutory rights are not affected by any of these terms.

This website handles orders for all countries apart from those listed below. To order from the other specified countries please click on the link provided to access the relevant website.

United Kingdom

USA, Canada, Puerto Rico, Virgin Islands and Guam

We regret that, due to local customs restrictions, we are not able to send any items to the following countries: Afghanistan, Algeria, Angola, Australia, Colombia, Egypt, Kenya, Kuwait, Libya, Moldova, Morocco, New Zealand, Nigeria or South Africa.

Our Commitment

Thompson & Morgan is committed to supplying high quality products to recreational gardeners and households for personal use and not for resale. In accordance with the established custom of the trade, Thompson & Morgan will in no case be liable for more than the actual amount paid for a particular item.


We will endeavour only to offer products which we expect to have in stock and available for ordering, but all items are subject to availability. Varieties that become unavailable will not be selectable on our website. Should a specific variety not be available at the time of despatch, or if items are of unsuitable quality to send, we undertake to supply a variety of similar colour and habit, and of an equal or greater value or send the item when available. This excludes fragrance products. If we are unable to supply your chosen fragrance we will contact you for further instructions. If no suitable substitutes are available, we will send a credit. Should you for any reason (including being unhappy with product substitutions) wish to receive a refund, you must return the product immediately.


Most seed orders are shipped within 5 working days of receipt of order. Please see special comments below for delivery of Christmas Gifts, other Gifts Items and Fresh Flowers.

There is NO minimum order value. Please avoid special requests (i.e. part shipment) since these cannot be complied with.

Although there is not normally any difficulty importing seeds, please note that:

"T&M seeds are intended only for export to countries where their cultivation is permitted. It is the sole responsibility of the purchaser to ascertain and obey all laws, which apply to the possession and cultivation of any items listed on our site. Please consult local, provincial and federal laws (including pertinent laws applied to your country) before placing an order. Thompson & Morgan does not assume any responsibility if customs or similar agencies confiscate seeds. The risk of delivery falls on the customer, therefore we will not be held liable as these products are intended only for export to countries where their cultivation is not restricted.


Unless otherwise stated, all selling prices quoted are inclusive of reasonable postage and packing. We make a charge for picking and processing orders (P&P). All such P&P charges are shown separately and added automatically to your shopping basket. Special conditions apply to non-EU countries. Please click here to view our online P&P information.

The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013

In accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have the right to cancel your order at any time up to 14 days after receipt. If you wish to cancel an order please contact our Customer Care department within 7 working days after receipt. You must take reasonable care of the goods whilst in your possession and they must be returned to us, promptly, at your cost. We can arrange collection of larger items, but you will be charged for this service at cost. We reserve the right to cancel any order.

Payment and Vouchers

We accept Visa and MasterCard credit/debit cards. If you wish to pay by cheque you will need to post your order to us. Please note that your account will be debited/cheque cashed on receipt of your order by us. If your card issuer or bank refuses to authorise payment to us, we will contact you for further instructions. We will not be liable for any resulting delay or non-delivery. Refunds are only payable to the purchaser of the goods.

Online vouchers and order codes are personal to each individual and any inappropriate use is fraud. We reserve the right to cancel any vouchers or order codes at any time. Please note that Vouchers cannot be used as a payment method for the purchase of more Gift Vouchers, in full or in part. Vouchers cannot be exchanged for cash and have no face value.


Prices reflect the latest prices for all products. However, we reserve the right to change prices at any time. All prices include VAT, if applicable.

If, in error, a product(s) has been priced inaccurately, either at unit level or through the activation of a promotion, we will not be liable to supply that item(s) to you at the inaccurate price. In such circumstances, we will notify you of the correct price and ask you to confirm or decline your order for the item(s) in question.

Endangered Species / Genetic Modification

We will not knowingly offer for sale endangered species harvested from the wild or any genetically modified products.

New and Exclusive

Where an item is defined as 'New' it is new to our range. Where an item is defined as 'Exclusive' it means that this item is believed to only be available in this form from us and our associated brands.


All rights, including copyright, in the content of our catalogues and web pages are owned or controlled by us. In accessing our web pages, you agree that you may only download the content for your own individual and non-commercial use. You are not permitted to copy, broadcast, download, store (in any medium) transmit, show or play in public, adapt or change in any way the content of our web pages for any other purpose without our prior written permission.

Third Party Information

We cannot be held responsible for material displayed on third party websites or any other written material. The only prices that apply for our products are those stated within our catalogues and website. We will not be bound to prices quoted by shopping directories or other media.

We strive to provide the best possible products and level of service we can. Where we do not, our experienced Customer Care staff are there to assist you. Their aim is to respond promptly and efficiently to all comments to ensure you receive 100% satisfaction.

Guarantee for 100% Customer Satisfaction

We promise to supply products in prime condition. If for any reason you are not 100% delighted upon receipt of your order, please advise us by email or in writing within 7 days - this allows a replacement to be sent promptly to ensure you still have time to achieve total satisfaction from your purchases.

In the unlikely event that you are not satisfied with your seed germination, please notify us within 30 days of the prescribed germination time (specified on the seed packet, catalogue or online product page) enclosing both the outer packet and inner foil sachet.

If any items do not come up to your expectations when you receive them, we will offer a replacement (subject to availability), or credit, or refund the purchase price. Just notify us within 7 days of receipt of the goods.

We cannot accept responsibility for items that fail to grow due to extreme weather conditions, over or under-watering, or which have not been cared for according to the easy-to-follow instructions supplied.

Images and Video

Any images or video materials submitted through any digital channels will become, by default, the copyright of Thompson & Morgan and its Group of companies. We may use your image for the foreseeable future in any marketing literature either online or in paper format.
